The teenager's grandfather is detained and placed in police custody until May 28; “Falsified CCTV footage”

The prosecution told the court that it had recovered the DVR (digital video recorder) of the CCTV at the accused's house, and the primary investigation indicates that the footage was allegedly tampered with and is to be sent for cyber analysis.

Meanwhile, Pune Police Commissioner Amitesh Kumar said the minor's father and grandfather offered money and gifts to their family's driver and later threatened him to take responsibility of the accident.

The prosecution requested the accused's custody for seven days because they wanted to recover the driver's phone which had been taken by the accused while he was “unduly confined”.

The court was also informed about past offenses registered against the minor boy's grandfather in Kondhwa, Bund Garden police stations in Pune and one in Mahabaleshwar in Satara district.

The Porsche, allegedly driven by the teenager, who police said was drunk at the time, killed two software engineers on a motorcycle in Kalyani Nagar area in the wee hours of Sunday, May 19.

Meanwhile, the accused grandfather told the court that when the accident happened, he was in Delhi and had reached Pune only on Sunday morning.

Objecting to custody, lawyer Prashant Patil, who is representing the accused, told the court that the driver was in the car at the time of the accident.

This is surprising since members of three generations are being held in one case, he said.

The teenager's grandfather and his father Vishal Agarwal, a real estate developer, were booked under IPC sections 365 (kidnapping with intent to secretly and unjustly confine a person) and 368 (concealing or keeping in unjust detention).

The defense attorney refuted the prosecution's claims that the driver was kidnapped and wrongfully confined in the house by the accused.

“As the incident caused an outcry, the driver chose to go alone to the servants' quarters in the accused's bungalow and stayed there till the next day. There is no question of the driver being threatened by the accused as he himself chose to go to the servants' quarters and stay there,” Patil said.

The accused grandfather has been with the police since he arrived in Pune from Delhi, he said.

“He spent 16 hours a day with the police,” Patil said.

Regarding the earlier cases registered against the accused grandfather, the defense lawyer said his client was acquitted in the Mahabaleshwar case.

Patil also informed the court about the health condition of the accused and asked the prosecution to collect relevant documents from his residence in case he developed any health problems.

After hearing the arguments, the judge remanded the accused in custody until May 28.

On Friday, the court remanded in custody the six accused arrested in the case, including the teenager's father. The teenager is in an observation home until June 5. PTI SPK NR NSK
