Teenager's mother feared for his life after he was pushed out of moving car

“He is a very intelligent boy who got high grades, and when he saw that he had just passed the subjects because he was in the hospital and unable to do his homework, [it] made him very angry.

“He still has many medical issues that need attention and that continues. [His] vision is affected and no one can tell me how bad it will remain… [he] continues to wear an eye patch on one eye every day to strengthen his eyes.

“To this day I am still in shock at what happened to me and I cannot believe what these young people are doing to them without thinking about the consequences.”

She told the court the attack had made her worried about her son's independence as she continually feared something would happen to him.

“Everytime [he] leaves the house or is far from me, I feel pain in my heart [sic]and I'm so scared that something will happen, and I can never rest or relax, and my health has been affected.

“Even today, I am still in shock of what happened to me and I cannot believe what these young people are doing to them without thinking about the consequences. »

The magistrate said the mother's comments were accurate and very sincere.

“No surprise, there’s no surprise,” he said.

“For me, this is nothing unusual. It is simply a terrible, nightmarish offense… and its consequences are utterly tragic.”

The court heard the trio accused of attacking the boy were driving around the area in a stolen Volkswagen Tiguan, robbing other teenagers who were leaving school, stealing phones and clothes.

The car drove towards the victim and his friend on Lloyds Avenue with two teenagers demanding his phone. When he refused, the boys slapped and kicked the victim and one of the boys “used a box cutter to inflict injury”.

The court heard one of the boys then grabbed the victim by his jacket and dragged him into the Volkswagen. The girl sped off with him hanging from the passenger door, feet dangling over the road, as they reached speeds of up to 70km/h.

Bystanders said the driver did not appear to know how to drive the car, and it raced at full speed and crossed the lanes, almost hitting another vehicle, while the windshield wipers were on.

The car drove erratically for about 150 meters on Neerim Road before the victim was ejected. The three teenagers did not stop to help.

Witnesses saw him have a seizure and vomit blood before passing out near the gutter, bleeding from the head.

On Wednesday, prosecutors did not ask that the girl be placed in juvenile detention, but rather that she be placed under a behavioral order.

His lawyer argued in court that his offense occurred in a context of emerging “mental health problems”.

The young girl will be sentenced in August.
