LUBBOCK, Texas – A probable cause affidavit obtained Tuesday by EverythingLubbock.com revealed that the teen arrested in connection with a shooting Friday night was struck by return gunfire after shooting at a home.

According to the affidavit, a police officer in the area of 18th Street and Buddy Holly Avenue heard gunshots and went to investigate. Andrew Maldanado, 17, was found with a gunshot wound to the abdomen in the 1900 block of Avenue N. It was later determined that a home in the 1500 block of 25th street was a suspected crime scene.

The affidavit revealed that a person who lived in the neighborhood was moving his family into their bedrooms due to a prior shooting and did not want them in the living room. Moments later, gunshots were heard, prompting the resident to reach for his firearm. Court documents say he “fired every shot” at the suspect before leaving.

It was reported to authorities that Maldanado and another person had “argued on social media” before the shooting, the affidavit states. Maldanado was found with a 9-millimeter firearm and was not wearing shoes. The affidavit says a pair of white Nike Air Force Ones were found about 50 feet from where Maldonado was found.

Video surveillance showed a man matching Maldonado's description walking in the area of the shooting, tucking a gun into his waistband. Maldonado was later seen on video fleeing suspected gunfire toward Avenue N.

The affidavit claimed Maldanado was the suspect based on the description of his clothing, his possession of a firearm and his gunshot wound. Maldanado was arrested and charged with aggravated assault with a deadly weapon and is being held at the Lubbock County Sheriff's Office at University Medical Center on $250,000 bail.
