A SHOOTING BETWEEN POLICE AND A SUSPECT INSIDE COLERAIN KROGER TOWNSHIP AFTER THESE OFFICERS WERE DISCOVERED OF ANY RELATED ACT EARLIER THIS WEEK. THE INNOCENT BYSTANDER, WHO WAS INJURED, TALKING ONLY WITH WLWT. Now, before we present it to you, we want to show you the body camera video that was released at the same time, showing those tense moments after officers followed the armed suspect into the store. GIVE ME A SECOND. COME HERE FOR A SECOND. DO NOT STOP. STOP! DROP YOUR GUN! DROP YOUR GUN. DROP YOUR GUN! This agent ends up eliminating the suspect. Shoot him in the eye. JOSEPH VAN NIEMAN, 42, NOW HAS DOZEN CHARGES, INCLUDING ATTEMPTED MURDER AND CAUSING PANIC. But he wasn't the only one hit by gunfire that day. A MAN JUST RUNNING TO THE BANK TO RUN AN RUN WAS AN INNOCENT VICTIM, AND FOR THE FIRST AND ONLY TIME, HE SPOKE WITH WLWT NEWS FIVE ANCHOR SHEREE PAOLELLO ABOUT HIS INJURIES AND EXPERIENCE. DAVID APPLEGATE, SENIOR, AND HIS DAUGHTER KRYSTAL JUST ENTERED THE KROGER IN NORTHGATE LAST WEDNESDAY WHEN EVERYTHING SUDDENLY HAPPENED. We heard this noise like fireworks, and we looked back and I saw the guys breaking open the doors and his arm coming through, and he had a gun. And I said, Krystal, get on the ground. That's all I think. GO TO THE FIELD. I had my hands like that, but I looked like that. AND THE SHOOTER WAS 8 TO 10 FEET TO OUR LEFT. A parking lot drug investigation went horribly wrong. David and Krystal were caught mid-shootout, but he ran past us to a screen to my left and turned and raised his gun. When they did, it was just a barrage of bullets. THEY JUST FLYED. To have bullets flying near your head that you can hear. It's like WOOF, WOOF. IT'S ALL OVER IN 39 SECONDS. But for this father and daughter who were hiding just a few feet from the shooter, it felt like an eternity. Pure panic, I was crying, I was shaking, I was hysterical, it was scary. IT WAS VERY SCARY. But the first thing I thought of was her. MY DAUGHTER. When the shooting finally stopped, the suspect, David, who had just undergone surgery for stage three colon cancer, realized he had been hit too soon. OH, I FELT AND SAID, JESUS. AND KRYSTAL SAID, ARE YOU OKAY? I said no, I'm touched. I thought he was dead, but when he arrived, he arrived here. AND THEN IT RADIATED AND MAN, IT WAS HOT. At first, officers thought David had been hit by shrapnel, but David says doctors later told him he had been hit by two bullets. One of them is still lodged in his knee. I think the worst. I think, OH Lord, I won't be able to walk again and right now I'm still struggling. AFTER A WEEK OF REFLECTION, KRYSTAL STILL HAS A LOT OF QUESTIONS ABOUT DOING THIS IN A VERY OLD PLACE, HOW ABSURD THIS SEEMS TO ME, AND IT'S VERY MUCH BARRING TO ME WITH THIS. LOADED WITH PEOPLE LIKE THAT. I'm surprised only two people were affected. DO YOU FEEL like the police did the right thing? I don't see where they did anything wrong. Um, I think they did their job and they got it done. Well, it's just that I was in the wrong place, at the wrong time. They still don't know how they fared that day. THIS OLD PREDICTION
