Shooting accused pleads guilty to marijuana theft turned shooting

A defendant charged in a robbery and shooting case scheduled to go to trial accepted a plea deal before Washington Superior Court Judge Errol Arthur on June 20.

Kevin Bailey, 24, was initially charged with conspiracy while armed, robbery while armed, possession of a firearm during a crime of violence while armed , assault causing significant bodily injury while armed, assault with a dangerous weapon and four counts of possession of a firearm during a crime of violence for his alleged involvement in a armed robbery and shooting involving two male victims inside a car on April 14, 2020.

The incident occurred at the intersection of Gallaudet Street and Central Place, NE. One of the victims was treated at the hospital for gunshot wounds to the right shoulder.

According to a police report, a victim said she arranged a transaction through Instagram to sell marijuana and would meet two black men. He said one of the men attempted to take marijuana without paying, while the second man brandished a gun at him. He told police he tried to run away, but heard two or three gunshots and realized he had been hit.

Despite a June 7 hearing in which the defense said she was ready to stand trial and Judge Arthur denied her motion to dismiss, defense attorney Daniel Dorsey said Bailey agreed to plead guilty.

The prosecution said it would have proven beyond a reasonable doubt that Bailey stole marijuana and intended to steal, used physical force and attempted to injure and assault with a firearm an individual driving a car, in addition to the robbery and the shooting.

The deal required Bailey to plead guilty to robbery, assault with a dangerous weapon and carrying a pistol without a license, dismissing all other counts in his indictment.

Judge Arthur read Bailey his rights to enter into a plea agreement and reiterated that he could remain free before sentencing if he complied with his conditions.

The parties are expected to return for sentencing on August 20.
