Sean “Diddy” Combs Files Motion to Dismiss Sex Trafficking Claim in Sexual Assault Lawsuit

Sean “Diddy” Combs fights back.

On Friday, Diddy's legal team filed a motion to dismiss some of the claims in a lawsuit filed by Joi Dickerson-Neal in November, accusing the music mogul of drugging and raping her when she was a student in 1991.

His legal team argues that some of the complaints were filed under laws that did not exist and against companies that were not established at the time of the alleged incident, according to documents obtained by USA TODAY.

USA TODAY has reached out to Dickerson-Neal's attorneys for comment.

Dickerson-Neal filed her suit in November in Manhattan Supreme Court, a day before New York State's Adult Survivors Act expired, and alleged she was drugged, assaulted sexually and abused by Combs, and that she had been the victim of “revenge porn,” according to court documents obtained by USA TODAY.

Diddy's attorney, Jonathan D. Davis, says the ASA doesn't allow Dickerson-Neal to “revive claims under laws that didn't exist,” including her allegations of sex trafficking and revenge porn .

The new filing later states that Bad Boy Entertainment, Bad Boy Records and Combs Enterprises – also listed as defendants in the suit – did not exist at the time the incident allegedly occurred and “no allegations of wrongdoing have been made.” been held against them,” concluding that Dickerson-Neal’s claims against the companies “fail as a matter of law.”

Combs denied Dickerson-Neal's allegations, saying the incident was fabricated and a “money grab.”

While on leave from school for the holidays in January 1991, Dickerson-Neal — who was then a student at Syracuse University — “reluctantly agreed” to have dinner with Combs, according to the suit. “During their date, Combs intentionally drugged (Dickerson-Neal), which put her in a physical state where she could no longer stand or walk independently,” the suit claims. Combs allegedly spiked her drink when Dickerson-Neal left her unattended to go to the bathroom, the suit reads.

In Dickerson-Neal's filing last year, she claimed Combs filmed the 1991 assault and distributed the tape to others in the music industry. This caused “serious harm to Ms. Dickerson-Neal's reputation, career prospects and emotional well-being,” Dickerson-Neal's attorney, Jonathan Goldhirsch, said in a news release sent to USA TODAY at the time.

Dickerson requested a jury trial.

Diddy is under investigation by multiple agencies for alleged sex trafficking and sexual assault. Agents with Homeland Security Investigations searched Combs' home in Los Angeles last month, according to Rolling Stone and local Los Angeles news channel Fox 11. Agents also searched Combs' residence in Miami, Rolling reported Stone, NBC News and Associated Press.

The Bad Boy Records founder faces several lawsuits filed in recent months claiming the music mogul raped or sexually assaulted multiple alleged victims over the past few decades. Combs has denied all charges against him.
