Robb Elementary families sue UPS for shipping gun used by shooter in 2022 school massacre

Families of survivors of the Robb Elementary School shooting are continuing their lawsuit against package shipping company UPS for allegedly violating state and federal laws as well as its own corporate safety standards.

The complaint was filed two years after the shooting, in which a gunman entered the school and murdered 19 children and two teachers. The families said UPS was responsible for the trauma and distress caused to survivors of the massacre.

On the day of the shooting, the shooter was armed with a gun ordered online and shipped to Oasis Firearms in Uvalde where it was later picked up by the shooter.

The lawsuit claims UPS then shipped an upgraded trigger system to the shooter's home. This allowed the shooter to convert it to a fully automatic or semi-automatic weapon.

The lawsuit cited UPS's conditions of carriage as evidence of a violation. UPS conditions state that “shipments must not contain any goods likely to endanger human or animal life or any other means of transportation. …”

The families also said sending the Hell Fire trigger to the shooter's home was a violation of school zone protections. The shooter's home was less than 1,000 feet from the Robb Elementary School area.

According to the lawsuit, the shooter was not 18 years old when he purchased the Hell Fire gun and trigger online. He claimed Oasis Firearms illegally transferred the gun to the shooter even though he was 17 at the time of purchase. The shooter was also able to purchase ammunition from Oasis that was used in the massacre.

This lawsuit was filed on the same day that the families of the victims and survivors also filed wrongful death lawsuits against Instagram's parent company “Meta”, the maker of the Call of Duty video game “Activision” and Daniel Defense, the company that made the video game. UPS did not respond to TPR's request for comment.
