Man pleads guilty to threatening North Carolina senator and his family; sentenced to probation

RALEIGH, N.C. (WNCN) — An Ohio man was sentenced to supervised probation after the North Carolina General Assembly Police Department reported he threatened a state senator State and his wife.

According to court records, Nicolas Alan Daniels, 38, of West Portsmouth, Ohio, appeared in Wake County District Court on Thursday and pleaded guilty to threatening a judicial official.

He was charged in February with 10 counts of communicating threats and two counts of felony threatening a judicial official, after arrest warrants indicated he threatened to kill the Carolina senator Northern Todd Johnson. Johnson is a Republican representing Cabarrus and Union County.

The warrants said Daniels sent Johnson a message on Facebook saying, “I'm going to kill you,” followed by an expletive. Police said Daniels also threatened to kill Johnson's wife and children via Facebook messages.

On Thursday, a judge sentenced Daniels to 6 to 17 months in addition to two years of supervised probation, during which he will be allowed to return to his home state of Ohio.

According to the judge, Daniels will also have to:

  • Submitting to warrantless searches by a probation officer
  • Obtain a substance abuse evaluation, obtain mental health assessment, monitoring or treatment as indicated within 30 days
  • Do not assault, threaten, harass, be found in or on the premises or workplace, or have contact with North Carolina Senator Todd Johnson
  • Do not approach as many meters from the victim/witness
