Todd Wildermuth, public information officer for the Roswell Police Department (RPD), said Pena was at the Adult Probation and Parole office in the Zero block of Grand Avenue for the charge contained in a warrant pending order issued on April 24.

A criminal complaint filed against Pena alleges he had sexual contact with a minor female relative on multiple occasions between December 2015 and June 2021. The sexual contact began when the alleged victim was 11 and ended when she was 16 years.

Police became aware of the allegations in August 2023, after an adult relative discovered messages on the alleged victim's phone in which Pena allegedly talked about wanting to have sex with her.

The victim later informed police that the incidents began while she and Pena were alone together at a residence. She explained that during the first episode, he pushed against her.

After that, the criminal complaint alleges the incidents escalated to include touching, removal of clothing and ultimately participation in sexual acts.

In the criminal complaint, the victim told police that Pena had sexual contact with her “too many times to count” and “she couldn't give a number.”

Some of the text messages Pena allegedly sent to the victim requested sex. The criminal complaint said in other messages he would advise the victim to meet him behind her house, warn her when he was near or outside the house, or if he was staying in a hotel.

None of Pena's text messages had a response from the victim.

According to the criminal complaint, the RPD tried but was unable to find Pena to speak to him about the alleged victim's allegations.
