Cuban victims of trafficking abroad have the right to family reunification in Cuba

New Migration law project published by the National Assembly of Popular Power (ANPP) Monday introduced a provision that grants Cuban victims of human trafficking the right to family reunification in Cuba.

According to the document, similar to Law No. 1312“Migration Law” of September 20, 1976, human trafficking activities are subject to international prosecution and may result in inadmissibility and possible expulsion from the territory.

Additionally, the law also imposes fines and administrative sanctions on businesses that violate immigration regulations, including those that may indirectly facilitate human trafficking.

An important aspect of the project presented by the ANPP is that it allows Cuban victims of such crimes to exercise their right to family reunification and return to the country on their own terms, with the support of international agencies or organizations. .

The document states that such requests can be submitted to a nearby Cuban consulate or office, which should provide support. Additionally, if the person is abroad, the migration authority will immediately notify their family in Cuba and facilitate communication between them.

The Migration Authority will take priority measures within the framework of its competences to offer special attention, in particular to minors. For the repatriation of a victim of human trafficking, international organizations or entities dealing with these issues may be involved, as indicated in the document.

It is crucial that people who wish to exercise their right to family reunification, after having been victims of human trafficking, provide informed consent to the appropriate consulate. Foreign nationals in this situation can apply for residency in Cuba under the category of humanitarian resident.
