Ahmedabad: Can a baseball bat be considered a weapon? A petition was filed in the Gujarat High Court after a teenager was arrested by Vadodara police last year for carrying a baseball bat, which they considered a weapon. Eighteen-year-old Nisarg Patel has filed a petition to quash the FIR filed against him by the Navapura police on October 2, 2023. The complaint states that during a drive-by check after midnight, Patel's car was stopped by a police group. They found a “golden colored baseball bat” in the back seat. The police asked the youth why he was carrying the baseball bat. Not finding his explanation satisfactory, they filed an FIR against him under Section 135 of the Gujarat Police Act, for violating the notification prohibiting citizens from carrying arms. While hearing Patel's quashing plea, Justice Nirzar Desai asked why he was carrying the baseball bat when the sport is not played in that part of the world. To this, Patel's lawyer said that the game was being played at a club in Vadodara and his client was participating in it. The judge later told a government lawyer that young people might like the sport. “You should have let him go after scolding him. He didn't beat anyone. The stick was in his car. He is a student. A baseball bat is considered a weapon by the police and an FIR is registered,” the judge said. The court added, “On perusal of the FIR, I do not find anything to indicate that an 18-year-old boy, the present petitioner, was caught using the baseball bat for any other purpose. Of course, this observation is prima facie in nature. At this point, this requires some thought. The court granted the request and restrained the police from acting in the case.
