Arrest in Birmingham gas station shooting

BIRMINGHAM, Ala. – The Birmingham Police Department has made an arrest in the investigation of a shooting at a Birmingham gas station in early May that left one person dead and six injured, according to Officer Truman Fitzgerald.

Early in the morning of Sunday, May 5, seven people were shot at the Shell gas station located at 800 3rd Avenue West.

David Westbrook, 24, of Wartrace, Tennessee, died from his injuries.

Police released photos last week of a person of interest in the shooting investigation, who has since been identified as 21-year-old Armonta Davis.

Davis turned himself in to police that same day and was later transported to the Birmingham City Jail and given a 48-hour felony extension.

Detectives have since obtained arrest warrants for Davis, charging him with attempted murder and first-degree assault.

He will be transported to the Jefferson County Jail.

According to police, shortly after 2 a.m. on May 5, officers from North and West Precincts were dispatched to several Shot Spotter alerts near the 700 and 800 blocks of West 3rd Avenue.

Police arrived on the scene and found a chaotic scene, according to media reports.

Officers observed that a white sedan had crashed into a utility pole and the victim inside was suffering from an apparent gunshot wound.

Birmingham Fire and Rescue (BFR) personnel arrived at the scene and later pronounced the victim dead.

Officers also observed an adult male lying unconscious in the parking lot of a Shell gas station.

BFR transported the adult male to UAB Hospital with life-threatening injuries.

At the scene, officers learned that two adult male gunshot victims had arrived at Princeton Hospital and two other adult male gunshot victims had arrived at UAB Hospital by private vehicle.

Around 10:30 a.m., officers also learned that a seventh adult male shooting victim had arrived at Princeton Hospital by private vehicle.

Police say the preliminary investigation revealed at least two parties were shooting at each other when several victims, vehicles and a business – Boston Fish Supreme – were struck by gunfire.

During the shootout, more than 150 bullets may have been fired.

Operation Knight Rider officers arrived and assisted patrol officers in arresting two adult males of interest for questioning.

Both men were seen fleeing the scene and attempting to throw guns.

According to the BPD, this is the 42nd murder investigation in Birmingham in 2024 with four justifiable death rulings.
