Alleged Grand Theft Auto and DUI suspect threatens to kill deputy, allegedly assaults Polk Fire Rescue paramedic

On May 24, the Polk County Sheriff's Office arrested 20-year-old Milo Pemberton. He was involved in a car accident and while being treated, he became combative. During the investigation, it was alleged that Pemberton assaulted both law enforcement and emergency response personnel.

The following is a lengthy excerpt from the Polk County Sheriff's Office affidavit and (It should be noted that this is an unedited, but redacted, factual report prepared by the PCSO. “On 5/24/24 at approximately 6:38 a.m., I responded to the area of ​​Florida Ave S and Shepherd Rd, Lakeland in reference to a vehicle crash with unknown injuries that was received by Live911.

Before my arrival, D/S Billek #9491 arrived at the scene and took primary responsibility for the investigation of the road accident.

Upon arrival, I contacted D/S Billek and assisted him in the investigation of the road accident. While on scene, I observed Polk County Fire/EMS providing aid to one of the drivers (later identified as Milo Pemberton). I was asked to stand by Polk County Fire/EMS because Pemberton was angry and verbally combative. Pemberton began to calm down and was escorted to the back of Polk County Rescue Ambulance #2 by Polk County EMS/Fire personnel.

Shortly after, Doctor #1 asked me to help Pemberton due to his behavior in the back of the ambulance. D/S Billek and I intervened in the back of ambulance #2. Upon entering, I observed Firefighter/Paramedic (Doctor) #2 attempting to restrain Pemberton who had removed the stretcher restraints. Doctor #2 informed Pemberton, “You don't know if I have a gun” and “I have a gun.” Doctor #2 advised that Pemberton began rummaging through his pants. Doctor #2 indicated that he feared imminent danger due to Pemberton's statements. Doctor #2 believed Pemberton had a gun, even though Pemberton appeared to be looking for one. Doctor #2 told him he tried to restrain the subject until law enforcement could help him further.

Due to Pemberton's gun threats, D/S Billek conducted a search of his person. During this search, an unopened “BuzzBallz Chiller” was located in Pemberton’s pocket. BuzzBallz coolers are alcoholic beverages containing 15% alcohol by volume. At the time of this incident, Pemberton was 20 years old.

Due to Pemberton's actions, Doctor #2 began applying soft restraints to Pemberton's wrists. D/S Billek and I assisted by keeping the subject on the stretcher while he continued to move and attempt to get off the stretcher. During this time, D/S Billek and I gave Pemberton several verbal commands to stop moving and remain still on the stretcher. I kept control of Pemberton's upper body and left arm. As Doctor #2 began to apply light restraint to Pemberton's left arm, Pemberton grabbed my right wrist with his right hand and attempted to pull it off his person. I immediately ordered Pemberton to let me go as he continued to push my arm away. I was able to remove my wrist from Pemberton's grip and handcuffs were applied in place of the soft restraints.

I got out of the ambulance and entered the patrol vehicle marked by my agency to follow Ambulance #2 to the hospital. Before leaving the scene, Doctor #1 exited the ambulance again and advised that Pemberton was able to remove his right wrist from the handcuffs. I got into the ambulance to put the handcuffs back on. While putting the handcuffs back on, Pemberton quickly moved his head towards me while shouting. Because of his actions, I thought Pemberton was trying to headbutt me and I had to move to stop that from happening. After I was handcuffed, Pemberton continued to try to headbutt me, saying, “When I get out of prison, I'm going to kill you.” » I placed my left hand on Pemberton's chest, pushed him away and told him to stop. Pemberton continued to threaten to kill me after leaving prison, but made no further attempts to headbutt me.

Ambulance #2 began transporting Pemberton to the hospital due to injuries from the crash and medical clearance for the jail.

In the area of ​​Old Hwy 37 and Oak Ln in Lakeland, Ambulance #2 activated its emergency lights and stopped on the side of Old Hwy 37. Medic #1 got out of the driver's seat and advised that Pemberton was actively fighting in the back of the ambulance. . As Doctor #1 opened the back door, I saw Pemberton kick Doctor #2 several times. I entered the ambulance and helped restrain Pemberton while Doctor #2 began obtaining items for chemical sedation.

I watched as Doctor #2 deployed medication into Pemberton's left buttock. As Doctor #2 was about to deploy the second drug, I observed Doctor #2 remove the needle cap and walk towards Pemberton. As Doctor #2 approached Pemberton, I observed Pemberton grab Doctor #2's left wrist (which was holding the uncapped needle) and begin to pull on it. Due to the unsealed needle and the struggle between Medic #2 and Pemberton, I immediately deployed my agency's Taser (S/N: X1200EW5X) via a stun technique for a full cycle of five seconds into Pemberton's abdomen while ordering him to release Doctor #2's wrist. While the cycle was being applied, Pemberton grabbed my right hand and the Taser with his right hand. Pemberton began pulling on the two in an attempt to remove the Taser from his abdomen. I gave Pemberton several verbal commands to let go of my hand and my Taser. During the five second cycle, Pemberton released his grip on Medic #2. After the five second cycle, Pemberton let go of my hand and made no further attempts to resist.

Ambulance #2 transported Pemberton to Bartow Regional Medical Center to obtain medical clearance.

During this investigation, D/S Billek learned that the vehicle (black 2021 Jeep Compass with FL tag #DAGC62) used by Pemberton prior to the accident belonged to DELETED (friend of Pemberton). REDACTED informed D/S Billek that she did not give Pemberton permission to take or drive the vehicle and that she wished to press charges. The vehicle was valued at $10,000.

During this investigation, D/S Billek and I wore our agency-issued Class B uniforms with silver “Deputy Sheriff” badges affixed to the front, badges on both arms, and agency-issued duty belts. The agency clearly identifies us as law enforcement. officers. Medic #2 wore his agency-issued uniform, consisting of a Polk County Fire/EMS shirt with “Firefighter” on the front and BDU-style pants, which clearly identified him as a firefighter.

Pemberton was arrested and charged with battery on a law enforcement officer (two counts), battery on a paramedic/firefighter, aggravated assault on a paramedic/firefighter, battery in fact against a law enforcement agent, resisting an agent with violence, resisting an agent without violence (two counts). counts), bribery by threat, grand theft of a motor vehicle and possession of alcohol by a person under 21 years of age. Pemberton was medically cleared by Bartow Medical Center and transported to the Polk County Sheriff's Office – Sheriff's Processing Center without further incident.
