Alec Baldwin faces retrial over 'Rust' shooting from victim's family

SANTE FE, N.M. (Court TV) — Actor Alec Baldwin's legal troubles are deepening as he faces a retrial following the deadly shooting on the set of his film “Rust.”

Baldwin, who is scheduled to stand trial this summer on manslaughter charges for the shooting that killed cinematographer Halyna Hutchins and injured director Joel Souza, now faces a civil suit filed by Hutchins' family and a member of the team. Baldwin pleaded not guilty to the charges against him and maintained that he never pulled the trigger on the gun.

The lawsuit, filed by Hutchins' mother, father and sister as well as Mamie Mitchell, who worked as a script supervisor on “Rust,” accuses Baldwin of assault and battery, infliction of emotional distress and accuses a much broader group of people associated with the film of negligence.

Hannah Gutierrez, who was convicted of involuntary manslaughter in March for her role in the deadly shooting as the film's gunsmith, is also named in the lawsuit, along with others involved in the film who testified at his trial, including assistant director David Halls, props designer Sarah Zachry and munitions supplier Seth Kenney.

Olga Solovey and Anatolii Androsovych, Hutchins' parents, and his sister, Svetlana Zemko, all live in kyiv, Ukraine, and filed a lawsuit with Mitchell, who, as script supervisor, stood by of Hutchins when she was shot.

“In the days before the shooting, unexpected shootings had been reported on the film set of”Rust“. “It’s very dangerous,” a cameraman wrote in a text message to the “Rust” production director. Furthermore, on the day of filming, but before it, the union cameramen and their assistants had walked off the job to protest working conditions, particularly for safety reasons on the set.

While the negligence and lack of safety, including the absence of a medical team on set, are allegedly the fault of the producers as well as Halls, Zachry, Kenney and Gutierrez, the plaintiffs claim that it was Baldwin who caused it. takes on a lot. of blame.

“Defendant Baldwin chose to play Russian roulette with a loaded gun without checking it and without the gunsmith doing so. His conduct and that of the producers on “Rust” were intentional and/or negligent acts and/or omissions, without any just cause or excuse and with complete disregard for the consequences of said acts and/or commissions.

Baldwin, crew members and the film's producers previously settled a wrongful death lawsuit filed by Hutchins' widow and son. That lawsuit was settled, but the terms of the deal were sealed.
