Abita Springs man sentenced to 40 years in prison for manslaughter | News

COVINGTON — District Attorney Collin Sims reports that on July 1, 2024, Dain McCann, 26, of Abita Springs, pleaded guilty to involuntary manslaughter and obstruction of justice.

After pleading guilty, he was sentenced by District Judge John Keller to 40 years in prison on each count, with both sentences running concurrently. The case was prosecuted by Assistant District Attorney Tiffany Dover.

Shortly before midnight on August 30, 2022, officers with the St. Tammany Parish Sheriff’s Office were dispatched to a residence in Abita Springs in response to a report of a shooting. Upon arrival, officers found Jon McIntyre, 30, with multiple gunshot wounds to the upper chest, abdomen, and right arm. McIntyre was still conscious when the first officers arrived. He informed an officer that “Dain McCann” had shot him. Shortly thereafter, McIntyre became unresponsive and succumbed to his injuries. Two hours later, while officers were still at the crime scene, a family member of McIntyre approached one of the officers and advised that she believed she had seen McCann on the porch of a nearby residence. Officers quickly went to the residence and located a man on the porch. When asked his name, the man said his name was “Devin.” Officers obtained a photo of Dain McCann and confirmed that the man who claimed to be “Devin” was in fact McCann. After being Mirandized, McCann admitted to shooting McIntyre. McCann said the victim approached him aggressively with a metal object in his hand, accusing McCann of owing him money. McCann said he pulled out his handgun and shot the victim three or four times in self-defense. When questioned further, McCann admitted to lying and that the victim was not armed with a weapon when McCann shot him. When detectives asked him where McCann’s handgun was currently located, he admitted to throwing it off a bridge into the Bogue Chitto River.

Several members of the victim's family were present in court during McCann's guilty plea and supported the sentence he received. Two of them made victim impact statements before Judge Keller sentenced McCann. McCann had no prior criminal record.
