Father, son and grandmother charged in Eastpointe shooting

MACOMB COUNTY — Three members of a family have been charged and arraigned in connection with a drive-by shooting that took place in Eastpointe Tuesday and a standoff with police in Casco Township.

All three defendants have a probable cause hearing scheduled for 8 a.m. July 9 in Eastpointe District Court.

Tyler Fistler, 21, a Casco resident, and his father, Derek Morris, a 51-year-old Port Huron resident, allegedly acted on prior online threats by shooting into an Eastpointe residence from a vehicle Tuesday. No one was injured in the shooting.

When officers arrived at Fistler's residence in Casco, Fistler was allegedly found in possession of a firearm as he entered his home. He and Derek Morris refused to go out. St. Clair County SWAT then attempted to contact them, but the men did not comply. Gas canisters were then deployed, forcing the father and son to come out. They were then arrested.

The investigation revealed that the vehicle allegedly involved in the shooting was at the residence of Derek Morris' 81-year-old mother in Port Huron. During a visit to the prison, Derek Morris said he asked his mother, Jaraldine Morris, to dispose of the evidence at her home. She would have accepted.

“Thank you to the Eastpointe Police Department and the St. Clair County SWAT Team for all of their hard work in investigating and taking this family into custody,” Macomb County Prosecutor Peter Lucido said in a statement. “This shooting endangered the lives of adults and children in our community, and we will see serious consequences for these actions. Such disregard for human life cannot and will not be tolerated.”

Fistler was charged with two counts of assault with intent to murder, one count of using a computer to commit a felony, one count of tampering with evidence, two counts of discharging a firearm from a vehicle, one count of carrying a concealed weapon, one count of felony firearm and one count of malicious use of telecommunications services.

Fistler's bail is set at $1 million with conditions including he must obtain a mental health evaluation, have no contact with the victim or crime scene, no internet, no weapons and a GPS cable.

Derek Morris was charged with two counts of conspiracy to commit assault with intent to commit murder, one count of accessory after the fact to a felony, one count of lying to a police officer during the investigation of a violent crime, one count of communicating with another to commit a felony and one count of malicious use of a telecommunications device.

Derek Morris' bail was set at $500,000 with the following conditions: he must undergo a mental health evaluation, have no contact with the victim or the crime scene, have no internet, have no weapons and carry a GPS.

Jaraldine Morris was arraigned on one count of tampering with evidence in a criminal case, punishable by more than 10 years in prison, one count of accessory after the fact to a crime, and one count of lying to a police officer during the investigation of a violent crime.

His bond was set at $50,000. She was sent to a community corrections center for mental health issues and upon release will be required to wear a GPS device.
